Registration of agreements on the alienation of exclusive rights and license agreements
According to the legislation of the Republic of Abkhazia, the right holder can grant another person permission (license) to use the object of intellectual property rights by concluding a license agreement or transfer fully or partially (sell) the rights to such object to another person, according to the alienation agreement.
Based on a license agreement, an exclusive or non-exclusive license may be issued.
Obtaining an exclusive license provides the licensee with a monopoly exclusive right to use the object of intellectual property and the licensor’s refusal to use it independently, which is the subject of a license agreement and its sale in the agreed territory at the agreed time.
Obtaining a non-exclusive license also gives the licensee the right to use the object of intellectual property in the agreed territory at the agreed time. However, this right is not a monopoly, and the licensor reserves the right to use the subject of the license agreement and grant licenses to other licensees.
The term for registration of a license agreement with the Patent Office of the Republic of Abkhazia is 1-2 months from the date of application.
